In today’s business environment, disputes are becoming increasingly complex, often crossing borders and involving multiple stakeholders. At 52 Gates Legal, our focus is on resolving these matters efficiently, strategically, and with minimal disruption to business operations.
Led by N. Janardhan Reddy, our Arbitration and ADR practice combines legal expertise with pragmatic strategy. The team advises on negotiation, mediation, conciliation, and arbitration, offering clients approaches to dispute resolution that are cost-conscious and focused on the outcome that matters to them.
We have experience handling domestic and international commercial arbitrations, as well as sector-specific disputes involving joint ventures, shareholder arrangements, construction, and infrastructure. Our work extends to proceedings under leading arbitral institutions, including ICC, SIAC and LCIA, and before ad-hoc tribunals.
Arbitration tends to suit commercial contracts where confidentiality matters, where the dispute is technical, or where the parties are in different countries and neither wants the other’s home courts. It is less suitable where urgent orders against third parties are needed, or where the amount in dispute is small compared with the cost of a tribunal.
Many arbitration problems begin with a poorly worded clause. When a contract is being negotiated, it is worth settling the seat of arbitration, the governing law, the institution or rules, the language and the number of arbitrators. We review and draft dispute resolution clauses as part of contract work.
How long does an arbitration take?
It depends on the complexity of the dispute and the co-operation of the parties. Indian law sets a time frame for domestic awards, which can be extended in defined circumstances.
Is an arbitration award final?
Largely, yes. A court does not rehear the case on merits; it can set aside an award only on specific grounds laid down in law.
Can we still settle after arbitration has started?
Yes. Parties may settle at any stage, and the settlement can be recorded as an award on agreed terms.
52 Gates Legal also maintains close associations with international counsel and professionals, enabling us to support clients in cross-border disputes and high-value commercial matters. Where a dispute must go to court, see our Litigation page.
