Real Estate Law

Real estate is a key driver of India’s economy, with Telangana among its most dynamic markets. Rapid urban growth, IT corridors and infrastructure projects bring both opportunity and legal complexity.

Our team advises on acquisitions, title due diligence, and the development of residential and commercial projects, industrial townships and SEZs. We handle both litigation and transactional work, combining legal precision with practical execution.

Real Estate Law

What we help with

  • Buying and selling property – title verification, agreements for sale, sale deeds and registration.
  • Title due diligence – tracing ownership, checking for encumbrances, pending litigation and land-use restrictions.
  • Development projects – development and joint development agreements, approvals and RERA registration.
  • Leasing – commercial and residential leases and leave-and-licence arrangements.
  • Property disputes – title and possession suits, partition, specific performance, injunctions and proceedings before the Real Estate Regulatory Authority.

What title due diligence involves

Before money changes hands, a buyer should know that the seller actually owns the property and can pass clear title. A proper check usually covers the chain of title documents going back several decades, the encumbrance certificate from the registration office, revenue and land records, approved building plans and occupancy certificate where there is a building, property tax and utility dues, and any court cases or acquisition proceedings affecting the land. For apartments and plots in a project, it also covers the project’s RERA registration and the builder’s rights over the land.

Steps in a typical purchase

  1. Verification. Title and approvals are checked and a written opinion is given.
  2. Agreement for sale. The price, payment schedule, timelines and each party’s obligations are recorded.
  3. Sale deed and registration. The deed is executed on payment of stamp duty and registration fees, and registered at the sub-registrar’s office.
  4. After registration. The buyer’s name is updated in the municipal and revenue records, and possession is taken.

Buying in a project

Buyers of flats and plots in registered projects have statutory protections, including the right to accurate information about the project, a written agreement for sale in the prescribed form, and remedies for delay in handing over possession. Complaints can be filed before the Real Estate Regulatory Authority. We advise buyers before they sign, and represent buyers and developers where disputes arise.

Common questions

Is a notarised agreement enough to own a property?
No. Ownership of immovable property passes only through a duly stamped and registered sale deed. Unregistered or merely notarised documents carry serious risk.

What is an encumbrance certificate?
It is a record from the registration department of registered transactions affecting a property over a given period, such as sales and mortgages. It is essential, but it does not replace a full title check.

Can an NRI buy or sell property in India?
Generally yes, with some restrictions, and usually through a power of attorney. See NRI Legal Services.

With knowledge of Telangana’s regulatory framework and local practice, we help clients obtain approvals and protect their investments. Developers, investors and corporates work with us on matters that need both legal accuracy and commercial sense. For court proceedings, see Litigation.
