Litigation

Disputes are an inevitable part of business and personal affairs, and effective resolution demands strategy, precision, and advocacy. 52 Gates Legal, based in Banjara Hills, Hyderabad, represents individuals, families and businesses in civil, commercial and criminal matters before courts and tribunals in Telangana and elsewhere in India.

Litigation

52 Gates Legal provides representation across civil, commercial, criminal, and white-collar matters. Our team handles contractual, corporate, property, regulatory, and employment disputes, with attention to protecting the client’s interests at every stage.

Types of disputes we handle

  • Civil and property disputes – title and possession, partition, injunctions, specific performance of agreements, and recovery of money.
  • Commercial and contractual disputes – breach of contract, supply and service agreements, and disputes between shareholders, directors or partners.
  • Criminal matters – complaints, bail, trials, appeals and petitions before the High Court.
  • White-collar and economic offences – investigations, regulatory proceedings and trials involving allegations of fraud, corporate mismanagement and compliance violations.
  • Employment and regulatory disputes – matters between employers and employees, and proceedings before regulators and statutory authorities.

Where a dispute is heard

The right forum depends on the subject and value of the dispute. In Telangana, a matter may be heard by a civil or criminal court at the district level, a designated commercial court, the High Court for the State of Telangana, or a specialised body such as the National Company Law Tribunal, the Real Estate Regulatory Authority, a consumer commission or a debt recovery tribunal. Choosing the correct forum at the start avoids delay and wasted cost.

How a matter usually proceeds

  1. Assessment. We review the documents and facts, identify the legal issues and the time limit for bringing the claim, and explain the realistic options.
  2. Notice and settlement. Many disputes begin with a legal notice and a reply. Where settlement is possible, negotiation or mediation is explored first. For most commercial suits, the law requires an attempt at mediation before filing unless urgent interim relief is needed.
  3. Filing and interim relief. The case is filed with supporting documents. Where necessary, the court is asked for interim protection, such as an injunction, while the case is pending.
  4. Evidence and hearing. Each side files its pleadings and documents, witnesses are examined, and arguments are heard.
  5. Judgment and after. A decision may be followed by an appeal, and a successful party may need separate execution proceedings to enforce it.

What to keep ready

It helps to bring the agreement or title documents in question, the correspondence between the parties (letters, emails and messages), payment records, any notices already sent or received, and a short written timeline of events. Every type of claim has a limitation period fixed by law, so early advice matters.

Common questions

How long will a case take?
It varies with the court, the nature of the dispute, and the conduct of the parties. Interim orders can sometimes be obtained early, while a full trial takes considerably longer. We give a realistic view at the outset instead of a fixed promise.

Can a dispute be resolved without going to court?
Often, yes. Negotiation, mediation and arbitration are available for many civil and commercial disputes, and a settlement can be recorded so that it is binding.

I live outside Hyderabad or abroad. Can I still pursue a case?
In many matters a party can act through a properly executed power of attorney, and courts may permit appearance or evidence by video conference in suitable cases. See also our NRI Legal Services page.
