Labour & Employment

India’s labour and employment framework spans numerous Central and State legislations, often creating complexity for employers and employees alike.

52 Gates Legal assists businesses in managing this landscape with clarity and precision. Our services cover employment contracts, workplace policies, compliance audits, and advice on statutory obligations. We also guide clients on dispute management, disciplinary processes, and employee rights, so that compliance is balanced with workplace efficiency.

Labour & Employment

What we help with

  • Employment documents – offer letters, employment contracts, confidentiality and intellectual property clauses, and consultant agreements.
  • Workplace policies – employee handbooks, leave and conduct policies, and the policy and internal committee required for sexual harassment complaints.
  • Statutory compliance – registrations and ongoing obligations relating to wages, working hours, provident fund, insurance, gratuity and bonus.
  • Disciplinary action and exits – show-cause notices, domestic enquiries, termination, resignation disputes and settlements.
  • Disputes – representation before labour authorities, labour courts and civil courts.

Getting the employment contract right

A clear contract prevents most later disputes. It should set out the role, pay and benefits, working hours, probation, notice period, confidentiality obligations and ownership of work created during employment. Clauses that restrain an employee after they leave, such as a bar on joining a competitor, are difficult to enforce in India, so the protection of the business usually rests on well-drafted confidentiality and non-solicitation terms.

Ending employment lawfully

How an employee can be terminated depends on who they are and why they are leaving. For employees covered by industrial law, the law lays down notice, compensation and, in larger establishments, permission requirements for retrenchment. Dismissal for misconduct normally calls for a fair enquiry in which the employee is told the charge and given a chance to respond. Skipping these steps is the most common reason terminations are overturned.

Workplace harassment complaints

Employers above the size set by law must constitute an internal committee, adopt a policy, and deal with complaints of sexual harassment within fixed timelines and in confidence. We help organisations set up the framework, train committee members and handle enquiries in line with the law.

Common questions

Can an employer hold back an employee’s final dues or relieving letter?
Earned wages and statutory dues must be paid within the time the law provides. Deductions are permitted only in limited situations, and withholding documents to pressure an employee invites legal risk.

Is a notice period buy-out or bond enforceable?
A reasonable notice period and recovery of genuine, documented training costs are generally enforceable. Penalties out of proportion to the actual loss are not.

Do labour laws apply to small businesses and start-ups?
Yes, though which laws apply depends on the number of employees and the type of establishment. See also Regulatory and Compliance.

Our approach is to provide solutions that are legally sound, commercially practical, and sensitive to employee welfare, helping organisations build sound internal systems while reducing risk. For court and tribunal proceedings, see Litigation.
